These Terms and Conditions ("Terms") govern your access to and use of the she.cy marketplace platform operated by She.cy Ltd., registered in the Republic of Cyprus. By creating an account or using our services you agree to these Terms in full. If you do not agree, please do not use she.cy.

1. Introduction

she.cy is a women-focused online marketplace operating in the Republic of Cyprus. Our platform enables users to buy and sell second-hand goods, offer professional services, discover local shops, and find employment opportunities — all within a trusted, women-led community.

The platform is operated by She.cy Ltd., a company incorporated and registered under the laws of the Republic of Cyprus. Our registered office is in Nicosia, Republic of Cyprus.

These Terms constitute a legally binding agreement between you ("User", "you") and She.cy Ltd.("she.cy", "we", "us", "our"). They are governed by the laws of the Republic of Cyprus and applicable European Union regulations, including but not limited to the General Data Protection Regulation (EU) 2016/679 ("GDPR") and the Cyprus Law 125(I)/2018.

2. Definitions

Platform
— the she.cy website, web application, and any associated services accessible at https://she.cy.
User
— any individual who accesses or uses the Platform, whether registered or not.
Seller
— a registered User who lists products, services, or job postings on the Platform.
Buyer
— a registered User who purchases or enquires about listings on the Platform.
Listing
— any product, service, shop, or job posting published on the Platform.
Content
— any text, images, descriptions, or other material submitted by Users to the Platform.
Personal Data
— any information relating to an identified or identifiable natural person, as defined under GDPR Article 4.

3. Eligibility

To use she.cy you must:

  • Be at least 18 years of age.
  • Have full legal capacity to enter into binding contracts under applicable law.
  • Not be prohibited from receiving our services under the laws of Cyprus, the European Union, or any other applicable jurisdiction.
  • Provide accurate, complete, and truthful registration information.

she.cy is a women-centered platform. While we do not technically restrict access by gender, our community guidelines and terms reflect and prioritise the safety and empowerment of women. We reserve the right to refuse service to anyone for any reason that does not violate applicable law.

By registering, you confirm that all information you provide is accurate and that you will keep it updated. Providing false information may result in immediate account termination.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials, including your password. You must notify us immediately at legal@she.cy if you suspect any unauthorised use of your account.

You may not create more than one personal account. Business users may maintain a separate business account in addition to a personal account, provided each account is used in accordance with these Terms.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the Platform.

Your account data is retained in accordance with our Privacy Policy. Upon deletion of your account, your personal data will be erased within 30 days, except where retention is required by law.

5. Marketplace Rules

5.1 Seller Responsibilities

  • All items listed must be accurately described, including condition, size, and any defects.
  • Sellers must own or have the right to sell all listed items.
  • Prices must include all applicable VAT and taxes in compliance with Cyprus VAT Law (Law 95(I)/2000).
  • Sellers are responsible for arranging delivery and communicating shipping costs clearly.
  • Business sellers registered for VAT in Cyprus must comply with all applicable VAT obligations.
  • Sellers must respond to buyer enquiries within 5 business days.

5.2 Buyer Responsibilities

  • Buyers must review listings carefully before purchase and contact sellers with any questions.
  • Buyers are responsible for completing agreed-upon transactions.
  • Consumer rights under Cyprus Law 112(I)/2005 (Consumer Protection) apply to all qualifying transactions.
  • Buyers have a 14-day right of withdrawal for distance sales under EU Directive 2011/83/EU, where applicable.

5.3 she.cy as Marketplace

she.cy acts as a marketplace facilitator only. We are not a party to any transaction between buyers and sellers. Disputes between users are the responsibility of the parties concerned. she.cy may, at its discretion, assist in mediating disputes but is not obligated to do so.

6. Payments & Fees

Subscription plans are offered on a monthly or annual basis. Prices are quoted in Euros (€) and include applicable VAT where required under Cyprus and EU law.

Free listings are available to all registered users subject to platform limits. Paid subscription plans unlock additional features as described on our Pricing page.

All transactions on she.cy are currently conducted directly between buyers and sellers. she.cy does not process or hold funds on behalf of users.

Subscription fees are non-refundable except where required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

7. Prohibited Content & Conduct

The following are strictly prohibited on she.cy:

  • Counterfeit goods, stolen property, or items that infringe intellectual property rights.
  • Weapons, drugs, controlled substances, or any items illegal under Cyprus or EU law.
  • Discriminatory, harassing, abusive, or threatening content toward any user.
  • Spam, misleading information, or false representations about products or services.
  • Adult content, obscene material, or content exploiting minors (violations will be reported to the relevant Cyprus authorities).
  • Unauthorised data collection, scraping, or use of automated tools without our written consent.
  • Circumventing platform fees or taking transactions off-platform to avoid our terms.
  • Creating multiple accounts to bypass account restrictions or gain unfair advantages.
  • Any activity that violates the Computer Misuse and Related Matters Law of Cyprus (Law 22(III)/2004).

Violations may result in immediate suspension, content removal, and/or reporting to relevant law enforcement or regulatory authorities in Cyprus.

8. Intellectual Property

The she.cy brand, logo, platform design, and all proprietary content are the intellectual property ofShe.cy Ltd. and are protected under Cyprus and EU intellectual property law, including the Cyprus Copyright Law (Cap. 59 as amended) and EU Directive 2019/790.

By posting Content on she.cy, you grant us a non-exclusive, royalty-free, worldwide licence to display, reproduce, and promote your Content solely for the purpose of operating and marketing the Platform. You retain ownership of your Content and may remove it at any time by deleting your listings or account.

You confirm that any Content you post does not infringe the intellectual property rights of any third party. We respond to valid intellectual property complaints under the EU Digital Services Act (Regulation 2022/2065).

9. Privacy & Data Protection

We process personal data in accordance with the EU General Data Protection Regulation (EU) 2016/679 ("GDPR") and Cyprus Law 125(I)/2018 on the Protection of Natural Persons with regard to the Processing of Personal Data. Full details of how we collect, use, and protect your data are set out in our Privacy Policy, which forms part of these Terms.

You have the right to access, correct, erase, restrict, and port your personal data at any time. You may also lodge a complaint with the Cyprus Commissioner for Personal Data Protection at www.dataprotection.gov.cy.

10. Cookies

she.cy uses cookies in accordance with the Cyprus Electronic Communications and Postal Services Regulation Law 112(I)/2004 (implementing the EU ePrivacy Directive 2002/58/EC as amended).

We do not use tracking cookies, advertising cookies, or third-party analytics cookies. The cookies listed above are strictly necessary for the operation of the Platform or for your convenience, and are exempt from consent requirements under the applicable ePrivacy rules. We do not use Google Analytics, Facebook Pixel, or any similar tracking technology.

11. Limitation of Liability

To the maximum extent permitted by Cyprus and EU law, she.cy shall not be liable for:

  • Loss or damage arising from transactions between users.
  • The accuracy, completeness, or legality of any listing posted by users.
  • Interruptions or unavailability of the Platform due to technical issues or maintenance.
  • Indirect, incidental, or consequential losses arising from your use of the Platform.
  • Loss of data, profits, goodwill, or business opportunities.

Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited under applicable law, including the Cyprus Consumer Protection Law 112(I)/2005.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of (a) €100 or (b) the total fees paid by you to she.cy in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless She.cy Ltd., its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of another user or third party; or (d) any Content you post on the Platform.

13. Termination

You may delete your account at any time from your dashboard. We will process your data deletion request within 30 days, subject to any legal retention obligations.

We may suspend or terminate your account with or without notice if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law or a competent authority.

Upon termination, your right to use the Platform ceases immediately. Sections on Intellectual Property, Limitation of Liability, Indemnification, and Governing Law survive termination.

14. Changes to Terms

We may update these Terms from time to time to reflect changes in law, our services, or industry practices. We will notify registered users of material changes by email or by a prominent notice on the Platform at least 30 days before the changes take effect.

Your continued use of the Platform after the effective date of updated Terms constitutes your acceptance. If you do not accept the updated Terms, you must stop using the Platform and may delete your account.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus and applicable European Union law, including GDPR (EU) 2016/679, the EU Digital Services Act (Regulation 2022/2065), and the EU Consumer Rights Directive 2011/83/EU.

Any disputes arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Nicosia, Republic of Cyprus, unless mandatory consumer protection rules in your country of residence provide otherwise.

Consumer users in the EU may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

In the event of any conflict between these Terms and applicable mandatory consumer protection laws, those mandatory laws shall prevail.
